Happy Tech respects your privacy and is committed to handling personal information responsibly. This Privacy Statement explains what information Happy Tech may collect, how it is used, how it is stored, and your rights under the New Zealand Privacy Act 2020.

1.1 Happy Tech is committed to protecting the privacy of individuals whose personal information we collect, use, store or otherwise handle.

1.2 This Privacy Statement explains how Happy Tech collects, uses, stores, discloses and protects personal information in connection with our website, enquiries and website design services.

1.3 Happy Tech operates in accordance with the Privacy Act 2020 and the Information Privacy Principles (IPPs) contained in that Act, including Information Privacy Principle 3A (IPP 3A), which came into force on 1 May 2026.

2.1 In this Privacy Statement:

(a) "Happy Tech", "we", "us" or "our" means Happy Tech, operated by Abrie Bester.

(b) "Personal information" has the meaning given to it under the Privacy Act 2020 and means information about an identifiable individual.

(c) "Website" means the Happy Tech website and any associated pages, forms or online services operated by us.

(d) "Services" means website design, website development and related services provided by Happy Tech.

3.1 We may collect, store and use personal information provided directly to us, including information submitted through our website, forms, email, telephone or other communications.

3.2 The information we may collect includes:

(a) name; (b) email address; (c) telephone number; (d) business name and business contact information; (e) information about a business and the services or products it provides; (f) website requirements, preferences and ideas; (g) information about requested website pages, content, features and functionality; (h) branding and design information; (i) links to websites, social media accounts and other online resources; (j) domain name information; (k) photographs, logos, documents and other files uploaded or provided to us; (l) messages, enquiries and other communications sent to us; and (m) any other information that you choose to provide.

3.3 Our website currently provides two Google Forms through which personal information may be submitted:

(a) a general contact form; and (b) a website planning form used to gather information required to understand and plan a website project.

3.4 The information requested through the website planning form may vary depending on the website package or requirements selected.

4.1 We use Google Analytics to understand how visitors use and interact with our website.

4.2 Google Analytics may collect information including the number of users, session and usage information, approximate geographic information, browser and device information, and identifiers collected through cookies and similar technologies.

4.3 Google Analytics uses first-party cookies to distinguish users and sessions.

4.4 We use Google Analytics information to understand website traffic and improve our website and services. We do not use it to collect passwords, payment details, or information beyond what is required for standard website analytics.

4.5 Information collected through Google Analytics is processed by Google in accordance with Google's own privacy policies and terms, which also apply to its handling of that information.

5.1 Personal information collected by Happy Tech may be used to:

(a) respond to enquiries; (b) contact you regarding an enquiry or potential website project; (c) communicate with you by email or telephone using the contact details you provide; (d) understand your business and website requirements; (e) assess which website option or service may be appropriate; (f) prepare and discuss pricing or quotes; (g) create, customise and develop websites; (h) use business information, text, images, branding and other material supplied by you in the creation of your website where this has been agreed; (i) provide and manage our Services; (j) maintain records relating to enquiries, projects and communications; (k) improve our website and Services; (l) analyse website usage through Google Analytics; (m) protect the security and integrity of our systems and information; (n) comply with legal obligations; and (o) establish, exercise or defend our legal rights where reasonably necessary.

5.2 We will not use personal information for a purpose unrelated to the purpose for which it was collected, unless permitted or required by law.

6.1 Information, text, images, logos, documents and other material provided to Happy Tech for the purpose of creating a website may be used for that website where this has been agreed with the client.

6.2 Personal information contained in material supplied for a website will not be published on the website unless publication forms part of the agreed website requirements or is otherwise authorised.

6.3 Clients are responsible for ensuring they have the necessary rights and permissions to provide material to Happy Tech for use in their website project.

7.1 Happy Tech may identify businesses that may benefit from our Services using information that is publicly available — for example, information published on business websites, social media pages, or online directories.

7.2 Where we collect personal information about you from a source other than you (indirect collection), and none of the exceptions in section 7.4 apply, Information Privacy Principle 3A requires us to take reasonable steps to make you aware of:

(a) the fact that your information has been collected; (b) the purpose for which it has been collected; (c) the intended recipients of the information; (d) the name and contact details of the agency collecting and holding the information (see section 14, Privacy Officer); (e) any applicable legal authority for the collection; and (f) your rights to access and correct the information.

7.3 We will generally provide this notice at first contact with you (for example, in the initial message where we introduce Happy Tech and ask if you're interested in a website).

7.4 IPP 3A does not apply, and no separate notice is required, where — among other exceptions set out in the Privacy Act — the information is already publicly available (such as information on a business's own website or a public directory), or you have already been made aware of the collection.

8.1 We use a small number of third-party technology providers to operate our website and store information, currently:

(a) Google Forms; (b) Google Sheets; (c) Google Drive; and (d) Google Analytics.

8.2 Where Google stores or processes information on our behalf (for example, form responses saved to our own Google Drive), Google is acting as a service provider handling that information for us — this is not the same as disclosing your information to Google for Google's own independent purposes, and does not make Google a separate holder of that information under the Privacy Act.

8.3 Personal information may otherwise be disclosed:

(a) where you have authorised the disclosure; (b) where disclosure is reasonably necessary for the provision of a service; (c) where required or authorised by law; (d) where necessary to establish, exercise or defend our legal rights; or (e) where reasonably necessary to prevent or investigate fraud, security issues or other unlawful activity.

8.4 Except as described in this Privacy Statement or otherwise permitted or required by law, we will not sell personal information or provide it to third parties for their own independent marketing purposes.

9.1 Google Analytics, Google Forms, Google Sheets and Google Drive may store or process information on servers located outside New Zealand.

9.2 Where a provider such as Google is merely storing or processing information on our behalf, rather than holding it for its own independent purposes, this is generally treated differently to a direct "overseas disclosure" under Information Privacy Principle 12 — we remain responsible for the information, and it continues to be protected in the same way as if we held it ourselves.

9.3 We take reasonable steps to satisfy ourselves that any provider we use for storage or processing offers an appropriate level of protection for personal information, consistent with our obligations under the Privacy Act 2020.

10.1 Personal information submitted through our Google Forms is stored in Google Sheets and/or Google Drive, in folders with access restricted to authorised Happy Tech Google account(s).

10.2 We take reasonable steps to protect personal information against loss, unauthorised access, use, modification or disclosure, as required by Information Privacy Principle 5.

10.3 No method of electronic storage or transmission can be guaranteed to be completely secure.

11.1 We will not retain personal information for longer than is required for the purposes for which it may lawfully be used.

11.2 We may retain information for as long as reasonably necessary to manage an enquiry or website project, maintain business records, resolve disputes, or comply with legal obligations.

11.3 When personal information is no longer reasonably required, we will take reasonable steps to securely delete or dispose of it.

11.4 Google Analytics has its own separate data-retention controls, configured within the Analytics account, which are independent of the retention period for our other business records.

12.1 You generally have a choice about whether to provide personal information to Happy Tech.

12.2 However, if information required to respond to an enquiry, prepare a quote or provide a Service is not provided, we may be unable to respond fully or provide the requested Service.

13.1 You have the right, subject to the Privacy Act 2020, to request access to personal information Happy Tech holds about you, and to request correction of information that is inaccurate, incomplete, out of date or misleading.

13.3 We may take reasonable steps to verify your identity before providing access to or correcting personal information.

14.1 Happy Tech has a privacy officer responsible for privacy matters.

14.2 The Privacy Act 2020 requires every agency to have at least one privacy officer. No separate registration with the Privacy Commissioner is required.

15.1 We will take reasonable steps to identify, contain and respond to privacy breaches involving personal information.

15.2 Where a privacy breach is likely to cause serious harm, we will notify the Privacy Commissioner and affected individuals as required by law.

16.1 Our website uses first-party cookies associated with Google Analytics, which help distinguish users and sessions.

16.2 Most browsers allow you to manage or block cookies through their settings. Blocking cookies may affect Google Analytics' ability to measure website usage but will not affect the operation of our forms.

17.1 Our website may contain links to third-party websites or services. We do not control their privacy practices and are not responsible for their content or policies.

18.1 We may update this Privacy Statement from time to time. The latest version will be published on this page with the date it was last updated.
